Divorce Mediation
Mediation is now mandatory throughout the state of Illinois in nearly all types of cases involving kids and parents. Specifically, by Supreme Court Rule, a case involving a dispute as to custody and visitation must be submitted to mediation if the parents are unable to reach an agreement on their own. The Rule further states that the parents must mediate for at least 3 hours before the case can return to court unless sooner resolved. The main types of cases that must undergo mediation are: Divorce/dissolution of marriage, paternity, and probate guardianship. Financial issues such as property division and child support are excluded from mediation.
It is important to select the right mediator; not just anyone can be a mediator. Mediators have to be trained and be certified within the Judicial Circuit served. The law office of Michael D. Risinger, P.C. has such training and certification for the 10th Judicial Circuit (encompassing Peoria County, Tazewell County, Putnam County, Stark County and Marshall County). Along with the training, I also have the experience of successfully mediating dozens of case.
Mediation sessions are conducted in the comfortable surroundings of the conference room at my office in Morton, Illinois where privacy and confidentiality are assured. Participation by outside parties is not allowed in the mediation sessions unless otherwise agreed to in advance in writing by all parties.
