Unlike a driver’s license suspension that ends on a specific date, you must attend a Secretary of State Reinstatement Hearing to have your license unrevoked if your driver’s license has been revoked.
I have extensive experience preparing people for what to expect in driver’s license reinstatement hearings. There are two types of hearings, formal hearings and informal hearings.
Informal Hearings – Informal hearings are typically for people who have had only one DUI conviction or are revoked for some other reason. They are held on a first-come first-served basis at various local Driver’s License facilities. After the hearing you will receive a short letter laying out the decision. If you are denied, you may request another hearing after 30 days.
Formal Hearings – In order to have a formal hearing you must submit an application and pay the fee to the Secretary of State. Formal hearings are held in a Springfield, Chicago, Joliet and Mt. Vernon, Illinois. You will not receive a decision immediately. A written decision will be sent to you usually within 45 days.
While I spend significant time preparing clients for secretary of state hearings, most people do not have their license reinstated at the first hearing. Typically they receive a Restricted Driving Permit (RDP), often referred to as hardship license. This is often used as a probationary device by the Secretary of State for one year. However, after nine months it is important to request another hearing. At this hearing my clients often have their full driving privileges reinstated.
